1. Acceptance of Terms
By registering an account or using Roadbooker, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the app.
2. Adventure Risk & Safety
Off-road navigation, overlanding, and adventure riding carry inherent and serious risks, including injury, death, vehicle damage, mechanical failure, adverse weather conditions, wildlife encounters, and becoming lost in remote terrain.
By using Roadbooker:
• You accept full personal responsibility for your own safety and the safety of others in your group.
• You must assess whether a route or stage is suitable for your skill level, your vehicle, and current conditions before travelling.
• You must carry appropriate safety, navigation, communication, and emergency equipment.
• You should inform a responsible person of your planned route and expected return time.
• You must comply with all applicable traffic laws, regulations, permits, and land-use restrictions.
• You acknowledge that conditions may change at any time due to weather, erosion, flooding, road closures, construction, farming activities, or other factors.
Roadbooker does not guarantee the accuracy, availability, safety, legality, or suitability of any route, stage, waypoint, track, roadbook, or navigation instruction.
3. Navigation Data Disclaimer
Roadbooker provides navigation information for informational and recreational purposes only.
GPS tracks, roadbooks, waypoints, maps, distances, directions, points of interest, and other navigation data may contain errors, omissions, inaccuracies, outdated information, or incomplete information.
You must exercise independent judgment at all times and must not rely solely on information provided through the app when making navigation, safety, access, or route decisions.
4. Land Access & Private Property
Stages published on Roadbooker may cross or approach private, restricted, conservancy, protected, agricultural, mining, military, or otherwise controlled land.
Roadbooker does not verify whether access rights exist for any route or stage.
It is your sole responsibility to:
• Obtain all necessary permissions before entering private or restricted land.
• Verify access rights with relevant landowners, authorities, conservancies, parks, or other governing bodies.
• Respect gates, fences, signage, closures, and local regulations.
Roadbooker accepts no liability for trespass, fines, penalties, property damage, environmental damage, vehicle recovery costs, or any other consequences arising from access issues.
5. User-Generated Content
Roadbooker allows users to create, publish, share, and access stages, routes, roadbooks, comments, ratings, photographs, and other content.
All user-generated content is provided by community members and not by Roadbooker.
Roadbooker:
• Does not verify the accuracy of user-generated content.
• Does not guarantee that content is current, safe, legal, or suitable.
• Does not endorse any route, stage, recommendation, rating, or comment.
• Reserves the right, but is not obligated, to review, remove, modify, or restrict content at its discretion.
You use and rely on user-generated content entirely at your own risk.
6. Responsibilities of Route Creators
If you create or publish a stage, route, roadbook, or other navigation content, you represent and warrant that:
• You have the right to publish the content.
• To the best of your knowledge, the information is accurate at the time of publication.
• You have not intentionally included false, dangerous, misleading, or malicious information.
• You will not knowingly publish routes that encourage unlawful activity, trespass, reckless riding, environmental damage, or unsafe conduct.
Roadbooker is not responsible for content submitted by route creators.
7. Environmental Responsibility
Users must travel responsibly and minimise environmental impact.
You agree not to:
• Damage vegetation, wildlife habitats, fences, gates, crops, or infrastructure.
• Enter areas where motorised access is prohibited.
• Leave litter or pollutants behind.
• Engage in conduct that may harm the environment or local communities.
You remain solely responsible for your actions while using Roadbooker.
8. Subscriptions
Roadbooker PRO includes a 7-day free trial for eligible new subscribers.
Following the trial period, your subscription will automatically renew at the applicable monthly subscription fee unless cancelled.
Subscriptions are billed through Google Play or the Apple App Store, depending on your device.
You may cancel at any time through your account settings on the relevant platform. Cancellation will take effect at the end of the current billing period.
Except where required by law or the policies of the relevant app store, subscription fees are non-refundable.
9. Intellectual Property
The Roadbooker application, software, branding, logos, trademarks, design elements, and original content are owned by Roadbooker and its licensors.
Content you create remains your property. By publishing content through Roadbooker, you grant Roadbooker a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and make available that content for the operation, promotion, and improvement of the platform.
10. Prohibited Conduct
You must not:
• Publish false, dangerous, misleading, or fraudulent route information.
• Harass, abuse, threaten, or impersonate other users.
• Use the platform for unlawful purposes.
• Upload malicious software, viruses, or harmful code.
• Reverse-engineer, tamper with, or interfere with the operation of the app.
• Attempt to bypass subscription controls, authentication systems, or security measures.
• Use automated systems to scrape, harvest, or copy content without permission.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Roadbooker, its owners, developers, employees, contractors, affiliates, and partners shall not be liable for:
• Death, injury, illness, or personal harm.
• Vehicle, equipment, or property damage.
• Recovery, towing, rescue, or emergency costs.
• Trespass claims or access-related disputes.
• Environmental or conservation-related penalties.
• Loss of profits, revenue, business opportunities, goodwill, or data.
• Any indirect, incidental, consequential, special, or punitive damages.
Roadbooker's total aggregate liability arising from your use of the platform shall not exceed the subscription fees paid by you during the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Roadbooker, its owners, developers, employees, contractors, affiliates, and partners from and against any claims, damages, losses, liabilities, penalties, fines, costs, and expenses (including reasonable legal fees) arising from:
• Your use of the platform.
• Your breach of these Terms.
• Your negligence or misconduct.
• Any route, stage, or content you create or publish.
• Any access, trespass, environmental, or property-related issues arising from your activities.
13. Service Availability
Roadbooker is provided on an "as is" and "as available" basis.
We do not guarantee uninterrupted access, error-free operation, continuous availability, or compatibility with all devices.
We may modify, suspend, or discontinue any part of the service at any time without liability.
14. Changes to These Terms
We may update these Terms & Conditions from time to time.
Material changes will be communicated through the app or other reasonable means.
Your continued use of Roadbooker after updated terms take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising from or relating to these Terms or your use of Roadbooker shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
